1. Use of Services
You may use our Services only as permitted by law and in accordance with these Terms. You must not misuse our Services, including but not limited to attempting unauthorized access, distributing malicious software, or interfering with the normal operation of the website.
2. Intellectual Property
All content on the Atlas Caravan website, including but not limited to text, graphics, logos, images, and software, is the property of Atlas Caravan or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.
3. User Content
If you submit or post any content to our Services, you grant Atlas Caravan a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content in connection with our Services. You are solely responsible for the content you provide and warrant that it does not infringe any third-party rights.
4. Purchases and Payments
a) Pricing: All prices are displayed in Canadian dollars (CAD) unless otherwise stated. Prices include applicable taxes (GST/QST) as required by law. We reserve the right to modify prices at any time, but changes will not affect orders already placed.
b) Payment Processing: Payments are processed securely through Snipcart and Stripe, our authorized payment processors. By making a purchase, you agree to provide accurate and complete billing information and authorize us to charge the applicable payment method for all fees incurred.
c) Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of pricing errors, product unavailability, suspected fraudulent activity, or violation of these Terms. If your order is cancelled after payment, we will issue a full refund.
d) Digital Products and Services: Upon successful payment verification, you will receive confirmation and access instructions for purchased digital products or services via email. Delivery timeframes are specified on individual product pages and vary depending on the service purchased.
e) Taxes: All prices are inclusive of applicable Canadian federal (GST) and provincial (QST for Quebec) sales taxes. Tax rates are calculated based on your billing address.
5. Subscription Services
a) Recurring Billing: Some services are offered on a subscription basis with recurring billing. By subscribing, you authorize us to charge your payment method automatically at the start of each billing cycle (monthly, quarterly, or annually as specified) until you cancel.
b) Subscription Management: You may manage your subscription, update payment methods, or view billing history by contacting us support@atlascaravan.com.
c) Price Changes: We may change subscription prices with 30 days’ advance notice. Continued use of the subscription after the notice period constitutes acceptance of the new price.
d) Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled in accordance with our cancellation policy.
6. Refunds and Cancellations
a) Refund Policy: Given the digital nature of our services, all sales are generally final. However, we will issue a full refund if:
- We fail to deliver the purchased service or product
- There is a technical error preventing access to purchased content
- Required by applicable consumer protection laws
b) Refund Requests: All refund requests must be submitted in writing to support@atlascaravan.com with your order details. We will review and respond within 5 business days. Approved refunds will be processed within 10 business days to your original payment method.
c) Subscription Cancellation: You may cancel ongoing subscription services at any time by providing 30 days’ written notice to support@atlascaravan.com. Your subscription will remain active until the end of the current billing period. No refunds will be issued for partial billing periods or unused portions of paid subscriptions.
d) One-Time Purchases: One-time digital service purchases are non-refundable once access has been granted or work has commenced, except as specified in section 6(a) above.
e) Our Right to Cancel: We reserve the right to cancel subscriptions or suspend services for non-payment, violation of these Terms, or if we discontinue a service. In such cases, we will provide reasonable notice and may issue prorated refunds at our discretion.
7. Chargebacks and Payment Disputes
a) Dispute Resolution: If you have concerns about a charge, please contact us first at support@atlascaravan.com before initiating a chargeback with your bank. We are committed to resolving billing issues fairly and promptly.
b) Chargeback Consequences: Initiating an unjustified chargeback may result in immediate suspension of your account and services. We reserve the right to dispute chargebacks and provide evidence of service delivery to financial institutions.
c) Fraudulent Disputes: If a chargeback is found to be fraudulent or unjustified after investigation, we may pursue recovery of funds and associated fees, and permanently ban you from using our Services.
8. Limitation of Liability
To the fullest extent permitted by law, Atlas Caravan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Services
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services
- Any errors in pricing, billing, order processing, or payment transactions (except where refunds are required under section 6)
- Any interruption or cessation of the Services
Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid to Atlas Caravan in the 12 months preceding the claim, or CAD $100, whichever is greater.
9. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. Atlas Caravan does not warrant that the Services will be uninterrupted or error-free, or that any defects will be corrected.
10. Termination
We reserve the right to suspend or terminate your access to the Services at any time and without notice, if you violate these Terms or if we suspect any fraudulent, abusive, or illegal activity.
11. Links to Third-Party Sites
Our Services may contain links to third-party websites or services that are not owned or controlled by Atlas Caravan. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts located in Montreal, Quebec.
13. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting an updated version on our website. Continued use of the Services after such changes constitutes your consent to the new Terms.
